Terms and Conditions

You are ‘the customer’.

We are Escape NZ – Boutique & Luxury Travel (referred to here as ‘Escape NZ’).

When we refer to a ‘package’, we are referring to all the different packages or ‘escapes’ we offer for sale, including bespoke packages.

When we refer to a ‘third party provider’, we are referring to individuals and companies we use in putting together a package for you – this includes hotels, luxury lodges, tour operators, drivers, pilots and so forth.

To confirm your booking, you need to confirm that you have read, understood and accept the below terms and conditions, including the section on Health and Safety.

Payment

All prices are in New Zealand dollars (NZD) and are GST inclusive.

A 25% non-refundable deposit must be paid by the customer to confirm their booking (whether this is a package offered on the website or a bespoke package prepared for the customer). This will allow Escape NZ to make bookings and pay deposits to third party providers on the customer’s behalf. The deposit will be credited towards the price of the package.

For a one day package with no accommodation, payment for the final balance is required 72 hours (3 days) before the package commences.

For a package including accommodation, the final non-refundable payment of the final balance is due 30 days before the commencement of the package except as set out immediately below.

Where the package includes reservations at The Farm at Cape Kidnappers, The Lodge at Kauri Cliffs, Matakauri Lodge, Huka Lodge or any other accommodation provider/luxury resort which requires full payment more than 30 days before the stay, full payment will be required more than 30 days before your stay and we will advise you of the details when we invoice you. For instance, with certain luxury lodges during the busy season, payment in full is required 60 days out from the stay (15 Nov to 22 Dec and 5 Jan to 6 April) and can be required in full up to 114 days out (on 1 September) for a stay over the holiday period 23 December to 4 January. Therefore the customer will need to pay Escape NZ in good time for Escape NZ to meet these costs. Escape NZ will invoice the customer, providing full details of when the final payment is required.

For a package which includes accommodation, which is booked within 30 days of the stay, Escape NZ may require non-refundable payment in full to secure the booking. In these circumstances, Escape NZ will specify the payment terms at the time of invoicing.

Escape NZ has the right to cancel any bookings made for the customer if full payment is not received in accordance with these payment terms and Escape NZ may classify the package as cancelled until full payment has been received.

If additional activities, more people or a longer stay are ‘added’ to the package after full payment of the balance has been made by the customer (‘Add ons’) Escape NZ will either invoice the customer, requiring immediate payment in full for the Add ons, or Escape NZ may accept a credit card as security, and the credit card will be charged for the Add ons after the package has concluded and all additional costs incurred are known (unless the customer prefers to pay for the Add ons by bank transfer or direct credit).

Payment by credit card is likely to incur additional processing fees. No processing fees will be charged for a bank transfer or direct credit.

Inclusions, Exclusions, Refunds and Limitation of our Liability

Each package has details of what is included. The customer accepts liability for all items, extras and upgrades the customer requests and/or which are not listed as being covered as part of the package and agrees to reimburse the accommodation provider, supplier and/or Escape NZ (as directed) for those costs without delay (for instance, the customer may need to give the hotel their VISA details for the mini bar and agrees to reimburse the accommodation provider for any costs incurred in relation to the mini bar on checking out).

Escape NZ accepts no liability to the customer for lost or damaged clothing, personal effects etc.

The customer accepts all legal liability to Escape NZ and any third party providers for the use of equipment and/or accommodation/facilities and any resulting damage, and in using/hiring the equipment, they confirm that they hold the appropriate licence for the use of that equipment.

Where the customer damages the car, boat, hotel/lodge room/suite/facilities or otherwise causes damage to the property of a third party provider or otherwise causes economic loss, the customer is liable for those costs/damages and Escape NZ reserves the right to pursue the customer for damages if the customer does not pay the cost of the damage and the third party pursues Escape NZ.

Escape NZ accepts no liability to the customer for cancellations or postponement due to natural disasters, inclement weather or other events beyond the control or knowledge of Escape NZ. In this event, Escape NZ will endeavour to reschedule the package at a time convenient to the customer, if the customer is happy to do this, and will apply the deposit to the package on the rescheduled date. If rescheduling is not practicable, or the customer does not want to reschedule, Escape NZ will refund the customer those costs not incurred, paid or payable to the third party provider(s), less the non-refundable 25% deposit payable on making the booking. For this reason, travel insurance is recommended – see below.

Where a package refers to a particular mode of transport, for instance a helicopter flight, if the weather turns and it is not safe to fly by helicopter, we will arrange another mode of transport, for instance a water taxi or seaplane, weather permitting, and we will endeavour to refund you for the difference.  However we will liaise with you on this as it may be possible to reschedule for a different day.

Escape NZ has no legal liability to the customer beyond the minimum prescribed by law.

Postponement (by customer)

Escape NZ will endeavour to reschedule all accommodation and activities on the customer’s preferred dates in the event of postponement by the customer, provided reasonable notice is given (what is reasonable may depend upon the circumstances).

However, the customer acknowledges that a postponement at short notice (and it will depend on the particular accommodation provider and their payment terms and cancellation fees) may result in up to a 100% charge by the third party provider and therefore the customer will forfeit those costs and be required to pay those costs again in rescheduling the package on a different date.

Cancellation (by customer)

In the event of cancellation, the 25% non-refundable deposit will be forfeited.

In the event of cancellation at short notice, unless Escape NZ is able to obtain a full/partial refund from the third party provider (it will depend on the particular accommodation provider and their payment terms and cancellation fees), there will be no refund of the balance of the package price, or only a partial refund. For this reason, travel insurance is recommended – see below.

Health and Safety

The customer acknowledges that participation in any activity may involve a degree of risk and that the customer takes responsibility for choosing to participate in that activity.

The customer acknowledges that Escape NZ does not under any circumstances guarantee the safety of customers participating in any activity and expressly excludes all liability howsoever arising in relation to the personal injury of any such customer or the loss of or damage to any property of any customer or third party.

At all times Escape NZ reserves the right to cancel, or amend without notice any scheduled activity due to weather conditions or any safety concern whatsoever, including customer unsuitability for any activity.

The customer agrees to abide by the health and safety policy of and any reasonable health and/or safety directions by a third party provider whilst participating in the package.

The customer confirms that they are 18 years or over and thus permitted to consume alcohol, and they agree to drink responsibly.

Whilst Escape NZ will take all reasonable and prudent steps to ensure the customer’s safety, the customer accepts that they are responsible for their own safety and they agree to behave in a responsible manner at all times and to supervise any minors in their care.

Customers must take extreme care with rotator blades on helicopters and planes, and participating in outdoor activities, particularly adventure sports, for instance, using jet skis.

Customers must check weather reports before embarking upon a hike or potentially dangerous outdoor activity or water sport. New Zealand weather is notoriously changeable and customers need to be vigilant and take steps to ensure their own safety and that of others in their care.

If the customer hires a vehicle or other equipment or machinery, they are responsible for its safe operation and must ensure they wear appropriate clothing/equipment and hold the appropriate licence(s).

If a dispute arises as to amounts payable by the customer to Escape NZ or a third party in relation to the package, legal liability, or as to the interpretation of these Terms and Conditions, the customer agrees that New Zealand laws apply and the customer submits to the exclusive jurisdiction of the New Zealand Courts in respect of all matters relating to it. However, that does not preclude Escape NZ from enforcing a judgment debt obtained in New Zealand against a customer overseas.

Marlborough and Hawke’s Bay have the best weather in New Zealand, and we will always have a back-up option up our sleeve, so if the winds are too high or visibility too poor for a helicopter or a seaplane, we will normally be able to get you to your remote destination on a water taxi, however we recommend travel insurance so that if you’re unable to travel at the last minute, your flights are delayed, or the weather is really bad (which may have a flow on effect on other bookings forming part of your package) we can reschedule to ensure you get to enjoy the very best New Zealand has to offer.
